Remitters' Process

The Rules of the program allow for a 'Remitters' Process' where organizations who are not Stewards can enter into Remitters' Agreements with Stewards (and with other Remitter organizations) in order to report and make payments on their behalf for the products that they supply to you (and that you supplied into the Ontario marketplace).

Please note that the Steward is still legally obligated for all EEE that is supplied for use in Ontario and the legal obligation does not transfer with a Remitter’s Agreement.  Under the terms of the Agreement, the Remitter only takes over the reporting and fee payment tasks from the Steward. The Steward who is distributing electronic products in Ontario is still required to file reports (which would exclude units covered by the Remitter) and indicate that they have Remitters.

Remitter's Agreements

This Remitters' Process has two parts:

  1. Both the Steward and the organization who wants to remit on its behalf must register with OES.
  2. Both organizations and OES have to enter into an online Remitter's Agreement and agree to the terms and conditions.

With the start of the Revised Phase 1 and 2 program, OES updated the contents of the Agreements that Stewards and other companies can enter into within the Remitter's Process.  Each Remitter's and Sub-Remitter's Agreement is comprised of two parts: the Agreement itself, and Schedule A.

Schedule A contains the list of brands associated with the Agreement and will be updated as required on a monthly basis, as organizations add, delete and modify brand lists.

Below you will find copies of the Agreements with changes made using the 'track changes'.  Previous versions of the Remitter's and Sub-Remitter's Agreements are no longer valid.

The Remitters' Process is voluntary. Organizations are under no obligation to participate. OES is a signatory to each agreement and each agreement has to be approved by OES to be valid. There is no expiry date on Remitter's Agreements and they can be cancelled by any party, at any time.

Sub-Remitter's Agreements

Remitters who have already entered into agreements with Stewards can also enter into secondary agreements with organizations who wish to make payments on their behalf. These types of agreements are called 'Sub-Remitters' Agreements.' 

A Sub-Remitter is an organization that receives EEE materials from a Remitter and supplies the materials into the Ontario market. A company that wishes to become a Sub-Remitter would sign an agreement to report and remit fees to OES. For a Sub-Remitter’s Agreement to be valid, it must be approved and signed by OES. There is no expiration date and the agreements can also be cancelled by any party, at any time.
