1) Reminder to all Stewards/Remitters and their Supply Chain Partners

WEEE Program Rule Changes effective December 1, 2010

Bits and Bytes Issue 91 signaled a change to Steward Rules effective December 1, 2010, indicating a number of changes related to the re-categorization of EEE products among material categories impacting Steward/Remitter reporting:

Revisions are coming to the WEEE Program Rules for Stewards related to the re-categorization of products within certain material categories. OES determined that a number of material fee rate categories were not properly reflecting the costs to manage certain materials. Specifically, OES identified printing devices in the Desktop Printing, Copying and Multi-Function Devices category that can operate with battery power and products in the Home/Non-Portable Image, Audio and Video devices category that are portable and/or have back-up or alternative power sources. It was determined that these products should be more appropriately placed in the Personal/Portable Image, Audio and Video Devices category.

In addition, OES is moving the Ultra Mobile PC from the Personal/ Portable – Image, Audio and Video to the Personal Computer category and clock radios to the Personal/ Portable – Image, Audio and Video category.

The implementation date of the above re-categorization of products as approved by the WDO Board is December 1st after which fee rates in Appendix B: EEE Material Definitions of the Rules for Stewards with Respect to Payment of EEE Fees will apply to March 31, 2011. Stewards and Remitters will file their December report using the new Appendix B Material Definitions by no later than January 30, 2011. The revised Rules are posted on the OES website.

Summary of Material Category Changes

The following items were removed from the Printing, Copying and Multi-Function Devices - Desktop Printing, Copying and Multi-Function Devices sub-category with a Steward’s fee of $5.40 and placed in the Personal/ Portable subcategory of the Image, Audio and Video category which attracts a $0.40 Steward’s fee:

  • Point of Sale (POS) receipt printers

  • Portable computer scanners

  • Portable PC-free photo printers

  • Handheld printers such as calculators with printing capabilities or label makers

  • Desktop label, barcode, card printers

The following items were removed from the Home/Non Portable – Image, Audio and Video category that has a $2.75 Steward’s fee to the Personal/ Portable subcategory of the Image, Audio and Video category that attracts a $0.40 fee:

  • Webcams

  • Digital picture frames

  • Portable AM/FM Radios

  • Compact docking speakers including computer speakers

For clarity, clock radios are being explicitly referenced in the Personal/ Portable – Image, Audio and Video category which attracts a fee rate of $0.40 fee. For additional clarity within the Home/Non Portable – Image, Audio and Video category, wording has been added to explicitly list the following EEE that may have had a non portable function:

  • Speaker systems, connected to a home audio or stereo system

  • Non portable AM/FM Radios

The following item was moved from the Personal/ Portable – Image, Audio and Video category that attracts a fee of $0.40 to the Personal Computer category that attracts a fee of $2.75:

  • UMPC- Ultra Mobile PC

OES has requested the opportunity to consult with EEE Stewards on the Form of Steward’s report contained in the revised Rules for Stewards; further communication on this issue to follow. In addition to Issue 91, OES sent out formal notification emails informing all registered Stewards, Remitters and Sub-Remitters of these changes. Please remember that Stewards and Remitters will file their December report using the new Appendix B Material Definitions by no later than January 30, 2011. The revised Rules are posted on the OES website.


2) October 2010 OES Report is due November 30, 2010

Stewards/Remitters and Sub-Remitters should already be tracking and reporting monthly the amount of EEE that they supply for use in Ontario.

  • Report and Payment #1 (revised Phase 1 & 2) for April 1-30, 2010 was due on May 30, 2010

  • Report and Payment #2 (revised Phase 1 & 2) for May 1-31, 2010 was due on June 30, 2010

  • Report and Payment #3 (revised Phase 1 & 2) for June 1-30, 2010 was due on July 30, 2010

  • Report and Payment #4 (revised Phase 1 & 2) for July 1- 31, 2010 was due on August 30, 2010

  • Report and Payment #5 (revised Phase 1 & 2) for August 1- 31, 2010 was due on September 30, 2010

  • Report and Payment #6 (revised Phase 1 &2) for September 1-30, 2010 was due on October 30, 2010

  • Report and Payment #7 (revised Phase 1 &2) for October 1-31, 2010 was due on November 30, 2010

Stewards who report and make payments according to the Revised (Phase 1 and 2) Fee Schedule in the Rules are considered to be in good standing with OES and compliant with the Waste Diversion Act (WDA) and the WEEE Program Plan Rules.

Non-complying Stewards may be subject to enforcement actions by the Ministry of the Environment as prescribed under Sections 36 - 41 of the WDA. Obligated Stewards and Remitters who fail to pay applicable EEE Fees may be subject to a penalty of 10% of the obligated EEE Fees due and payable. Interest may be charged at the Interest Rate on any outstanding balance due.

4) How to add a Purchase Order Number to your OES Invoice

OES Reporting System allows Steward, Remitters and Sub-Remitter to add Purchase Order (PO) numbers either at the time of entering their data or anytime thereafter. To add a Purchase Order Number simply enter the number in the Purchase Order Number field indicated below. Once completed, please save the page and continue to the Invoice Listing tab where you can download the updated invoice with the PO now added. Please note you will be required to enter new PO information on a monthly basis.

5) How to remit payment to OES

OES provides information that enables Stewards, Remitters and Sub-Remitters to download their invoices from a confidential web-based system. For more information on invoices and payment options, please review Bits & Bytes Issue 89.
